ALPHASIP SANTACLARA. (hereinafter “ALPHASIP“), is the owner of the domain www.alphasip.es, as well as the website published and hosted under that domain, made available to its users (natural or legal persons) to provide information about its corporate identity, products, and services.

In accordance with the provisions of current legislation, users of www.alphasip.es (hereinafter, the “Website“) are hereby informed of the following general information:

2. – Terms of use

Users are obliged to make proper use of the Website in accordance with the Law and this Legal Notice. Users shall be liable to ALPHASIP or third parties for any damages that may be caused as a result of a breach of this obligation.

It is expressly forbidden to use the Website for purposes harmful to the property or interests of ALPHASIP or that in any other way overload, damage or render useless the networks, servers and other computer equipment (hardware) or products and computer applications (software) of ALPHASIP or third parties.

3. – Industrial and Intellectual Property

The Website, including its graphic design, as well as its contents—including, but not limited to, text, photographs, graphics, images, software, and other content—are the intellectual property of ALPHASIP or of third parties who have licensed it to ALPHASIP, without any of the exploitation rights recognized by current intellectual property laws being transferred to users. Users must refrain from reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the contents, except to the extent necessary for browsing the Website, in cases authorized by law, or when expressly consented to by ALPHASIP.

The distinctive signs (trademarks, trade names, etc.) are owned by ALPHASIP without it being understood that access to the Website gives users any right to those trademarks, trade names and / or distinctive signs.

4. – Exclusion of liability

4.1.- Availability of the service

ALPHASIP attempts to keep the Website operational and error-free, but users agree to use the Website at their sole risk. The Website is provided on an “as is” basis without warranty of any kind, either express or implied, and therefore, except as may be legally required under applicable law, we make no warranties as to its merchantability or fitness for a particular purpose, nor do we warrant that access to or use of the Website will be uninterrupted or error-free. In addition, access to the Website requires the services and supplies of third parties, including transport over telecommunications networks, the reliability, quality, security, continuity, and operation of which WOOPTIX does not own or control. WOOPTIX is not responsible for failures or disconnections in telecommunications networks or other services provided by third parties that cause the suspension, cancellation, or interruption of access to the Website.

4.2.- Of the contents and services linked through the Website

The Website may include links that allow users to access other Internet pages and portals (hereinafter, “Linked Sites“). In these cases, WOOPTIX acts as an intermediary service provider in accordance with Article 17 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (“LSSI“) and will only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of their unlawfulness and has not disabled the link with due diligence. If users consider that a Linked Site contains illegal or inappropriate content, they may notify WOOPTIX in accordance with the procedure and the effects established in Clause 5 of this Legal Notice, without in any case such communication implying an obligation to remove the corresponding link.

Under no circumstances shall the existence of Linked Sites imply the existence of agreements with their managers or owners, nor the recommendation, promotion, or identification of WOOPTIX with the statements, content, or services provided.

4.3.- Security of the Website

The connection to the Website is made through open networks, and WOOPTIX does not control the security of data communications or of equipment connected to the Internet. It is users’ responsibility to have appropriate tools for the prevention, detection, and removal of harmful computer programs or malicious software. Information on free tools for detecting malicious software, such as viruses, Trojans, etc., can be obtained from the OSI website: https://www.incibe.es/ciudadania/herramientas.

WOOPTIX is not liable for any damage caused to users’ computer equipment during connection to the Website by acts of third parties, or for the lack of security or confidentiality of information transmitted through third-party equipment and telecommunications networks, or because of software or hardware vulnerabilities in users’ own equipment.

5. – Communication of activities or services of an illicit and inappropriate nature

If users or any other third party become aware that Linked Sites, content, or any other service provided through the Website are unlawful, harmful, defamatory, violent, contrary to morality, or otherwise infringe the rights of third parties, they may contact WOOPTIX providing the following:

Personal data of the complainant: name, address, telephone number, and email address. WOOPTIX will be responsible for processing the personal data voluntarily provided for the sole purpose of responding to the request. Users may exercise their rights in accordance with the provisions of the Privacy Policy. The omission of any of this information may result in the request not being answered, without prejudice to any voluntary inquiries WOOPTIX may choose to make.
Description of the facts demonstrating the unlawful or inappropriate nature of the service.
In the event of a violation of rights, such as intellectual or industrial property or any other rights whose existence could not be determined by WOOPTIX, documentation must be provided proving the existence of the infringed title or legal right. Additionally, the personal data of the owner of the infringed right must be provided when this is a person other than the complainant, along with proof of authorization to act on behalf of the owner in such cases.
An express statement that the information contained in the complaint is accurate. The receipt by WOOPTIX of the communication provided for in this clause does not imply, pursuant to the provisions of the LSSI, actual knowledge of the activities and/or content indicated by the complainant.

Users who wish to know what data processing is carried out on the Website, as well as the cookies used on it, can consult our Privacy Policy and Cookies Policy.

7. – Validity and termination

WOOPTIX reserves the right to make changes to this Legal Notice, publishing any changes in the same manner in which this Legal Notice appears or through any type of communication to users or other appropriate method.

Therefore, the validity of this Legal Notice coincides with the time of its publication, until it is totally or partially modified, at which time the modified Legal Notice will come into force. Consequently, users must read this Legal Notice carefully each time they access the Website.

WOOPTIX may terminate, suspend, or interrupt, at any time and without prior notice, access to this Website or any of the services provided through it, without the possibility for users to claim any compensation. After such termination, the prohibitions on the use of the contents set out above in this Legal Notice shall remain in force.
